ral Ralph Darling, Command- ing His Majesty's Force*, Captain General and Governor in Chief of the Territory of Nea) South Wale* and its Dependencies, and Vice Admiral of the same, Sfc. $c. <.yc.
WHEREAS by au Act of Parlia-
ment passed in the Ninth Year of the Reign of His present Majesty, in tuletl " An Act to provide for the Admi " ujstration of Justice in New South «< Wales and Van Dicmen's Land, and « for the more eil'cctual Government <» theroof, and for other Purposos re <« lating thereto," it is amongst other Things enacted, that a Notice of the «oiicral Objects of every Lav/, or Ordi- nance, to bo proposed by the Governor, »hall be published in one or more of the Newspapers of the Colony, Eight eiear Pays before such Law, or Ordinance, shsil be passed; but that in a Case of Ei.iergon.cy, the Governor and Council shall have Power to pass such Law, or Ordinance, as they shall deem requi- site without any such Nolico as afore- said. And whereas the Crimes of Rob- bery and Houscbreaking have recently increased to an alarming Degree, and it in become necessary to restrain the snme, as mueh as possible, by temporary Pnn isions suited to the Emergency of the Occasion, NOW I, THE GOVER- NOR, do issue this my Proclamation to <ñ\e Notice, that an Act has this Day passed the Council, intitled An Act " to suppress Robbery and Housebreak " ing.and the llarbouringof Robbers and " Housebreakers," in Order that allPer soiis may take Notice thereof, and govern themselves accordingly.

breaking, and the Harbouring of Rob-
bers and Housebreakers.
T--3TH ERE AS the Crimes of Robbery
V v and Ilousebreaking have in ereisod to an alarming Degree, and it is bei' mc necessary to restrain the samo, as much as possible, by temporary Pro- visions, suited to the Emergency of the Occasion ; Be it therefore Enacted, That it shall be lawful for any Person whatsoever, having reasonable Cause to suspect and believe any other Person, to be a transported Felon, unlawfully at large, immediately by himself, or with the Assistance of other Persons, and without a Warrant for such Purpose, to apprehend, or cause to be apprehended, every such «uspected-Person, and him to take or cause to be taken before any Jus- tice of the Peace of the Colony, for Exa- mination as hereinafter provided,
XI. And be it further Enacted, That every suspected Person, who shall be taken before any Justice of the Peace as aforesaid, shall be obliged to prove, to the reasonable Satisfaction of such Jus- tice, that he is not a Felon, wider Sen- tence of Transportation ; and in Default of such Proof, such Justice of the Peace raav cause fcuoh Person to be detained in safe Custody, until it can be proved whether he is a transported Felon, or free ; and in every such Case, the Proof of being free, shall be upon the Person alleging himself to'bé* free. Provided al- ways, that every such Justice of the Peace may, in his Discretion, cause every such suspected Pei'son to be se- curely removed to Sydney, to be there examined and dealt with ia like Manner as aforesaid.
III. And be it further Enacted, That every Person whatsoever who shall be found on the Roads, or in any other Part of the said Colony, with Fire-arms or other Instruments of a Violent Na- ture in his Possession, under Circum- stances affording a reasonable Ground for suspecting that such Person may be or intend to bo a Robber, every guch ?uspooted Person shall be liable to be apprehended, and taken before a Justice
of the Peace in like Manner, and be dealt with, in all Respects, as herein- before is provided, in Reference to Per- sons suspected of being transported Fe- lons unlawfully at large; and in every »uch Case, the Proof that such Fire- arms or other Instruments of a violent Nature, were not intended for au illegal Purpose, shall be «poa the Person in
whose Possession the ¡same shall be found as aforesaid.
IV. A«dbe it further Enacted, That it abalice lawful for any Peraon having reasonable Canse for suspeoting and be- lieving that any other -Parson may have «ny Fire-arms, or other Instrument of a deadly Nature, concealed about hi3 Per- ron, to search, or cause to be searched, «very «uch suspected Person ; and in Case of discovering any such Fire-arms, oi' other Instrument of a violent Nature, to apprehend, or cause to be appre- hended,.such Person, and to take him before any Justice of the Peace, to be j ^eSlt*with ia jill Respects as hereinbe-

V. Audbe'it further Enacted, That

boured in the County or District where- in such Justice of the Peace shall be or reside, to grant a general Search War- rant to any one or more Constables, to aearch any Dwelling-house, orTencuicnt, or "other Phce within, or reputed tobo within such County or District; audit shall be lawful for any such Constable or Constables, in Virtue of.such general Warrant, to break, enter, and search, by Day or by Night, any Dwelling house, Tenement, or 'other' Place within, or reputed to be within ^auch County or District, and to apprehend1, or cause to be apprehended, every Per-
son whom such Constable or Constables shall have reasonable Cause for suspoct iug and believing to be a Robber or House Hreakcr, and to seize and secure all Fire-arms, and other Arms or In- struments of a violent Nature, and all Goods and Chattels which such Con- stable or Constables shall have reason-
able Ground for suspecting and believing to be stolen, and also to apprehend all Persons found in or about any such i> ivelling-House, or Tenement, or other Place, and whom such Constable or Con- stables shall have reasonable Grounds
for suspecting and believing to harbour and conceal auy such Robbers and Housebreakers as aforesaid; and all Persons, Arms, Goods, and Chattels, so found, seized, and apprehended,as aforer said, shall, by such Constable or Con-
stables be forthwith taken before a Jus- tice of the Peace for Examination, and to be further dealt with according to Law.
VI. And whereas it is expedient that Robbers and Housebreakers should be
tried and punished as speedily as may bg consistent with the Endsof Justice ; J3e it therefore further Enacted, That all Per- sons who shall bef ully pommitted for tile Crime of Robbery,orof entering and plun dei'ing any Dwelling-house, with Arms and Violence, shall be brought to Trial as soon as possible ; and being lawfully con- victed of any such Crime, and sentenced to suffer Death, snail be executed ac- cording to Law on the Day next but two after Sentence passed, unless the same shall happen to be Sunday, and in that Case, on the Monday following, and such Sentence shall be passed immediately after the Conviction of such Offender, unless the Court or Judge shall see rea- sonable Cause for postponing the same.
VU. And be it further Enacted, That every person who shall be found with any Fire-arms, or other Instrument of a vio- lent Nature, in his Possession, and shall not piwe to the Satisfaction of such Justice of the Peace, as aforesaid, that the same was or were not intended to be
illegally used,as hereinbefore isprovided, shall be deemed to be guilty of a high Misdemeanor, and being thereof law- fully Convicted, shall be liable, at the Discretion of the Cou>*¡, to be imprisoned for any Time not exceeding three Ye^.rs.
VIH. And for the more effectual en-
forcing this Lawor Ordinance, be itfurther Enacted, That all His Majesty's Subjects shall be liable) to be called upon to aid and assist any Constable or other Person in executing and enforcing the several Provisions thereof; and every Person who shall be so called upon to aid and assist, and shall refuse or neglefct so to do, shall be liable to a Fine not exceeding Five Pounds, to be recovered and lev ied in a summary Manner, before any Justice oi the Peace, over and.above any other Punishment to which such Person shall bo liable by Law.
IX. And be it further Enacted, That, if any Action or Suit shall be brought against any Justice ol' the Peace, Con-
stable, or other Person or Persons, for1 any Act or Thing since the Tenth Day of this Instant Month of April, or at any Time during the Continuance of this Act, done, in Furtherance of the Objects, or in Pursuance of the Provisions, ol' this ' Law or Ordinance, the Détendant or De- fendants, in every such Action or Suit may plead the general Isäio, and may gi\ethis Act and the special Matter m Ev ¡dence at any Trial to be had there- ,| upon; and if the Verdict shall be for the j Defendant or Defendants in any such ! Action or Suit, or if the Plaintiff or
Plaintiffs be nonsuited, or discontinue j his, her, or their Action or Suit, after the Defendant or Defendants shall have ap- peared, or if upon Demurrer Judgment shall be given against Plaintiff or Plain- tiffs, the Defendant or Defendants shall have treble Costs, and shall have like Remedy for the same as any other De- fendant or Defendants bath or have in any other Case to recover Costs by Law.
X And be it further Enacted That this Law or 'Ordinance shall continue in force for two Years from the Passing and -Publication thereof. __-. ^ "

J for the Church and Parsonage at Bathurst, including a Well, Persons desirous of Contracting for the imme- diato Execution of die same, are re- quested to send into this Office, by Twelve o'Clock of Saturday, the 23d of May next, sealed Tenders, endorsed " Contract for Bathurst Repairs," and specifying the Peripd within which the Work will be completed, with the Naqies of at least two Sureties for its due Performance.

IIEREAS, JOHN MACNA- MARA, per Ship Brampton, a Runaway from No. Í) Iron Gang, stands charged with the MURDER, of Con- stable KENNY, on the Western Road, about Two Miles from Parramatta, oir the Afternoon of Sund «y, the 4th Instant ; Notice is hereby given, that the above Reward of (£50) Fifty Pounds will be paid to any Person, who shall lodge the said John Macnamara in any of His Majesty's Gaols, or give such Informa- tion as may lead to his Apprehension ; and if the Party be a Prisoner, he will
also be allowed a Conditional Pardon.
The said John Macnamara stands
about 5 feet 8 inches high, sandy com plexion, about twenty-eight years of agc,
and wore at the time he committed the Murder, a black beaver hat, white jean trowsers, white cotton stockings, yellow striped waistcoat, and drab coloured jacket. He had also a false Certificate
of Freedom.

Tim Asylum is designed for the reception of aU persons who aro unable to maintain themselves, either through age or bodily infirmities, and to assist indi- viduals of tomperato habits who can only in part support themselves, whom the Committee lolieve by small weekly supplies of bread, toa, sugar, clothing, &c as tlio nature pf the case may'ioquire.
