MOTOR-CYCLIST'S CLAIM.
Awarded £175 Damages.
Robert Andrew Dart, of Murray street, Elstern- wick, engineer's apprentice, was riding a motor- cycle near the junction of Clarendon street and Dorcas street, South Melbourne, on August 8, when a motor-car, driven by Daniel Dow?? of Toorak road, Toorak, struck his machine side on. Dart was thrown to the roadway, and he sustained concussion and shock, a broken nose, a fractured jaw, and other injuries.
Before Judge Foster in the County Court yes- terday, Dart, through his brother, Linton Dart In.nu'lil III netinii claiming £499 damages from Dow??. Dow?? denied negligence.

Mr. M???? appeared for Dart, and Mr. Flannigan and Mr. Morn mi (instructed by Messrs. Pavey, Wilson, and Cohen, appeared for the defence.
At the end of the IM Judge Foster said that the evidence of defendant indicated negligence on his part. There would be judgment for plaintiff, and damages would be assessed at £175.
Judgement was entered accordingly, with costs.
