MINERAL LEASES.

The following Regulations for granting Mineral Leases having boen approved by His Excellency the Governor-in-Chief. with the advice of the Executive Council, aro published for general information.

ü. M. WATERHOUSE, Chief Secretary. REGULATIONS FOR GRANTIKG MINERAL LEASES.

1. Applications for leases for a term of 14 years of mineral lands, in blocks not exceeding eighty acres each, are to be accompanied by such local description and any other information as will serve to identify tho spots ; a statemnt in writing is also to be made in each case, whether tho applicant is the original discoverer of tho mineral, or whether he is authorized by the original dis- coverer to make the application for the loase. A sum of £5 must be paid at the time of lodging each applioa? tion, which sum w11 be allowed out of the deposit of 10s. per acre, to be paid at tho time of lodging the plau.

2. Within three months from the date of any applica- tion, or such further time-not exceedin six additional

months-as may be fixed by the Government, a plan must be lodged with the Surveyor-General, fixing the exact position of the land applied for, with reference to some known trigonometrical point (if such exists within fifteen miles of the claim), and describing the boun- daries of the block. A deposit of 10s. per acre must also bu paid at the time of lodging this plan.

3. The applicant will be entitled to one year's right of search, from the time at which the position of the block has to be fixed, and the plan lodged.

4. The applicant will forfeit his claim to a lease by removing, or causing to be removed, from the land, prior to his having accepted a lease, any ore. oxecpting for samples, and then not exceeding one ton in the

whole.

Twelve months before the termination Of a lease, i the lessee, if desirous of obtaining a renewal thereof, may apply for, and shall be entitled to a renewal for a further period of fourteen years ,'from expiration of the current lease, upon payment of a fine of not less than £1 nor moro than £20 per acre ; such fine to be fixed (three months before the expiration of such lease) by the Inspector of Mines, or such other officer as may [ be appointed by the Government for that purpos and

to be confirmed by the Governor in Executive

Council.

C. Should the lessee not intimate his desire to obtain a'renewed lease twelve months before the date of the

expiration of the term of his current lease, the land will then be dealt with by the Government as may be deemed best, in accordance with any law or regulation affecting the waste lands of the Crown for the time being

in force.

7. The Government shall havo the power of pin -* chasing machineiy, pumps, mining materials, ores at grass, &c., if not removed by the lessees within three months from the expiration of his lease, in case tho lessee does not take out. a renewed lease.

8. The lessee shall bo allowed three months from the expiration of his lease to remove machinery, pumps mining materials, and ©res already at grass.

9. The value of all substantial and useful improve , ments on the surface of the ground shall be added to the

upset price of the lease of the land when offered for sale, j and such value shall be paid by the incoming tenant, within three months, if tho land is rolot to any other than the original lesseo ; such valuation to be estimated,

at the date of termination of lease, by two valuators, I one named by the Government and the other bj' the j lessee ; and finally, in case of dispute, by an umpire chosen by tho two valuators.

10. Should the lessee become the purchaser of the lease of the land, the sum added to the upset price, as the valuo of the improvements, will be allowed iu abato ment of the purchase money.

11. Should any other person than the lessee become the purchaser (or tenant, if the land 19 relot), the value of the improvements will be paid to tho lcbsce by the

Government.

12. In the event of the laud not being sold or relet, the lesseo will not receive the v.iiuo of the improvements.

[Clauses 9,10,11, and 12 of these regulations shall be applicable only at the expiration of the first fourteen years' lease.]

13. The lease will become void and forfeited, if the lent be not duly paid yearly in advance ; or if a sum equal to at least £3 per acre bo not expended annually on the land so leased for mining purposes ; or if three men have not been employed for at least nine months in ach year of the term of tho demise in working on tho land demised by such lease, and in developing the mineral resources of the land ; evidence whereof, if required ; must be furnished to tho satisfaction of the Inspector of Mines, or such other officer as may be ap- pointed by the Government for that purpose.

14-, Every lessee shall have power to determine the case, on giving three months' notice.

15. Whenever there shall exist on the waste land, applied for and leased by virtue of these regulations any natural spring or wator, or nny water obtained bj' artificial means by the holder of tho pastoral lease of such land, a right of access to such water shall be re- served in the lease io the owner of the run on which such mineral block shall be surveyed ; and reserves for roads or other purposes of public utility may be made bj the Government in any lease.

lo. Leases ol' lands applied for, but not fixed and j surveyed within three months, or such further time not exceeding six months-as may be fixed by the Government, and the leases of land surrendered or forfeited, may be put up to auction by the Government.

17. All mineral lands which have been applied for, but the site of which has not been fixed, ma}' be put up to auction by the Government as mineral lands, and sold 0 the highest bidder.

18. AU mineral lands put up to auction and passed, may at any time be put up to auction again, at the request of any person guaranteeing the upset price.

19. It shall be competent for the Government, in the event of the land remaining unsold, or unlet, to abate tlw value of the improvements, at the expiration of every three months after the lease has expired, by one fourth of their original amount ; and to offer the land again at public auction, quarterly, at the reduced j)rice ; and, upon sale thereof, to pay the lessee the reduced

Whereas, by an Act of the Parliament of South Aus- tralia, i^assed in the twenty-second year of Her Majesty's reign, intituled " An Act to amend the Waste Lands Act," it is enacted, that it shall be lawful for the overnor, by and with the advico of tho Executive Council, by Proclamation published in the South A us Iraliaii GovernmeutGacetle, from time to time, to make, vary, and alter regulations affecting timber licences : And whereas it is expedient to vary and alter the regu- lations now in force, and to make other regulations iu lieu thereof. Now, therefore, I, the said Govcruor-in Cliief, by and with the advice of the Executive Council, do hereby proclaim and declare, that the regulation's hereinbefore referred to, and published in the South Australian, Government Gazette on the nineteenth day of April, one thousand eight hundred and sixty, shall, from the date of the publication hereof, be rescinded, and in lieu of such regulations so rescinded, I do hereby further proclaim and declare, that the severa regulations comprised in the Schedule hereto annexed, shall have the force and effect of law, that is to say .

SCHEDULE REFERRED TO.

1. From and after this date, annual licences to cut and remove timber upon and from the Waste Lands of the Crown will bo issued by the Commissioner of Crown Lands, or those authorised by him, on payment of a fee

of £5.

2. Licences to cut and remove taken out during the last half of a year will be charged £3.

3. Quarterly licences to remove timber will also be gi-anted on payment of a fee of £1 5s.

4. These licences, which will only authorise the person named therein to cut and remove, or remove timber during the periods specified therein, are not transferable, except under the written authority of the Commissioner of Crown Lauds, or those authorised by him.

5- The licence will not authorise tho holder to cut or ! remove timber on any Waste Lands leased for pastoral

or any other purpose, nor on any iands surveyed, or. under course of survey, for sale or public roads and reserves. Special permission in writing will, however, be given by the Commissioner of Crown Lauds, or those authorised by bim, on applica- tion, if approved, to cut and remove timber on leased runs, and will be limited to such portion of a run, and subject to such conditions, as shall be indicated in the special permission.

6. Timber cutters or carters will not be allowed to ocate themselves on Waste Lands, except in a tem- porary manner ; nor will they be allowed to depasture any cattle on the Waste Lands except those actually required for removing the timber.

7. Every person licensed to cut and remove timber must exhibit his licence to every officer of Government when requn-ed to do so ; and all persons licensed to cut an d remove timber, by special permission, on Waste Landa, leased for pastoral or other purposes, must, in ad- dition, exhibit (when required) his licence to the occu- pier of the run, oi his agent ; and all persons cutting or removing timber without a licence will be prosecuted and all persons refusing to exhibit their licence, when required as above, will be held to be unlicensed.

8. These regulations apply to aU Waste Landa not being within the boundaries of a district constituted under the District Council Act.

9. If it shall appear to the Commissioner of Crown Lands that the sale of any portion of the Waste Lands of the Crown, whether -within a district constituted undei the District Councils Act, or without such district, would bo injuriously affected by its being denuded of its timber, it shall- be lawful for such Commissioner, by notice to that effect published in the Government Gazette, to prohibit the cutting and removal of timber upon and from such portion ; and from and after the publication ot such notice, every licence to cut and remove timber shall be held not to extend to or authorise the cutting and removal of timber upon .io from such portion.
