On yesterday the 11th inst. I was working with the deceased and John Brown at 11.30 am. We were undermining a fall and had worked in about two feet when John Brown went to the top of the bank to knock down the earth that we had undermined. I saw John Brown on the top where there was about 2ft. of sand, with a spade removing the surface sand to try to get down on the solid clay. After that I saw him lifting a crow bar to try to knock the bank down. Immediately the bank fell down and John Brown fell with it, with the crow bar in his hand. The deceased was the next man to Brown when he fell. The deceased jumped down to pull out John Brown. At the same time a second fall of earth came down which crushed the deceased. I was standing within two feet of the deceased when he jumped to extricate John Brown. When I looked around I saw the deceased covered with earth with the exception of his head and shoulders. I, with the other men, tried to lift the lump of earth off the deceased, the lump of earth that was on his back was about a ton and a half weight which crushed him against another lump. In about a half a minute we extricated the deceased when he was dead. The deceased was bleeding from the mouth and nose. When the second fall of earth took place which caused the accident, the ground was not undermined, it was purely accidental.Signed: Ch. Fr. DellitJacob BOLLING is my direct ancestor. Her death certificate lists the causes of death as Bronchitis and Dropsy. Her maiden name was KRUGER. This couple were passengers of the maiden voyage of "Susanne Godeffroy" which arrived Moreton Bay January 1864. One child of their, Herman LENZ, aged 2, died on the voyage. |

Next of Kin when enrolled, John William KIRLEY of Cootamundra. Walter Edward KIRLEY was a Labourer, aged 21 years and 2 months, Church of England. Records show he died 28 August 1960, In 1967 his wife, Alma May KIRLEY applied for Gallipoli Medal "in memory of my late husband". There is correspondence in 1916 from a Miss A. CONWELL who was "keeping company" with Walter Edward KIRLEY. NSW BDM shows the marriage in 1919, Sydney registsration, of Alma M. CONWELL and Walter Edward KIRLEY. Walter Edward KIRLEY returned to Australia in 1916. He had serious groin wounds. NSW BDM has the death of John Edward KIRLEY's brother, his Next of Kin, in 1950, Cootamundra Registration. Parents: Matthew Thomas and Emily, same parents shown for death of Walter Edward KIRLEY.
